Terms of Service

These terms are an agreement between you and NextForm AI ("we", "us"), which operates OceanToken. They govern your use of the OceanToken console and API. By creating an account or sending a request you agree to them.

Your account

You must give an email address you control, keep your password and API keys secret, and tell us promptly if you believe a key has leaked. Anything done with your key is treated as done by you, so rotate a key you no longer trust. One person, one account; do not share credentials.

Credit and billing

OceanToken is prepaid. You add credit, and each request draws down your balance at the price shown for that model in the console. When your balance reaches zero, requests are refused until you top up. Prices can change; the console always shows the current price, and a change never applies to a request already served.

Charges are computed from the usage each provider reports. If we find a billing error in your favour we correct it. Unused credit is not transferable between accounts.

Acceptable use

Do not use OceanToken to:

• break the law, or infringe someone else's rights;
• generate material that sexually exploits children, or that incites violence against people;
• build or refine weapons, or attack computer systems you do not own;
• impersonate a person or organisation in order to deceive;
• circumvent our rate limits, our safety filters, or the terms of the underlying model providers.

Requests are screened automatically for a narrow set of safety categories. Screening can refuse a request; that refusal is part of the service working as intended, not a fault.

Your content

What you send stays yours. You give us only the permission we need to run the service: to transmit your request to the model provider you chose, to store it as the Privacy Policy describes, and to show it back to you. Output generated for you is yours to use, subject to the underlying provider's own terms.

You are responsible for having the right to send what you send, and for how you use what comes back. Model output can be wrong, and can be confidently wrong. Check anything you rely on.

Availability

We aim to keep the service running and will give notice of planned maintenance where we can. We depend on upstream model providers, so an outage at one of them can affect the models it serves. We do not currently offer a contractual uptime guarantee.

Suspension

We may suspend an account that is breaking these terms, that is being used to attack the service, or that we are required to suspend. Where the situation allows it we will tell you first and give you a chance to put it right.

Ending the agreement

You may close your account at any time from the console. We may end this agreement on reasonable notice. On termination your right to use the service stops; the Privacy Policy governs what happens to your stored records.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit, or for loss arising from your reliance on model output. Nothing here excludes liability that cannot lawfully be excluded.

Changes

If we change these terms we update the date at the top and, for a material change, email account holders before it takes effect. Continuing to use the service after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. The state and federal courts located in California have exclusive jurisdiction over any dispute arising from them.
